I think your description of the flaw makes sense. To use the language that PowerScore uses in categorizing flaws, the stimulus seems to make an "error in the use of evidence" (see lesson 7). More specifically, it's taking a lack of evidence for a position/some evidence against a position as proving that the position must be false.
