Why is this a justify stem:

Which one of the following is an assumption that would serve to justify the conclusion above?

Is it because would introcudes uncertainty and asssumption stems need a "must"?

It asks for an Assumption, so it's either a regular Assumption (also known as a Necessary assumption) or a Justify question (also known as a Sufficient Assumption). But look at the rest--they tell you they want it to Justify the Conclusion, which is what a Justify question does. So it's not about uncertainty at all, and more about the direct language being used in the stem itself.
