Hi Dave,

I recently listened to your Podcast #77 referring to the January 2021 LSAT (which I did NOT take). I noticed you mentioned a Reading Comprehension passage related to computer simulations in the courtroom. I explicitly remember a passage such as this. You had mentioned it was from September 2017, I believe (or maybe from one of the experimental sections/international exams from October 2010 or February 2016). However, I remember this passage from PT 49, June 2006. Although it has been used more recently, those exams were not disclosed to test takers. So, assuming that the passage you were referring to in the podcast is identical to the passage from PT 49, would it then be beneficial to study passages from 50-52 for the February or April 2021 exam? Thanks.

Hi Steph,

Thanks for the question! While it may sound topically similar to a disclosed passage, the passage used on the January 2021 Flex exam would not have appeared on any prior disclosed test. The only place it could have appeared is on an undisclosed test (like an international test) or an experimental section (which are never disclosed). LSAC does not reuse material from tests that have been disclosed, partly because it would give an unfair advantage to those who have seen the material in their studies and partly because it would interfere with the curve. It does happen sometimes that there is topical overlap between passages or questions on disclosed tests (e.g. I've seen lots of Logical Reasoning questions about Alzheimer's disease and its causes). But there is never a true "repeat" of material from a disclosed test. So, while the practice tests from the 2006-2007 testing year you're referring to are great for practice purposes, you can rest assured that none of the specific material from them will appear on any coming Flex tests.
