I had trouble with question 9:

I was torn between D) and E) and eventually picked D) since the author says that those political compromises looked more to the "temper of the times than to enduring principles of law." Thus, I thought the problem doesn't lies in political compromises per se, but with that second half of the sentence (looking more to the temper of the times instead of the enduring principles of law). However, the correct answer is E). What makes D) wrong and E) right?
